60K-5.032(1) Administrative leave counts as hours of pay, but not count as hours of work for overtime purposes.

60K-5.032(2) Approval of administrative leave is limited to an amount necessary to bring the employee to full pay, 40 hours of work in the workweek, the number of approved hours in the extended work period or the number of hours in the work period. In no case can the approval of administrative leave cause the employee to exceed 40 hours during the workweek, hours in an approved extended work period, or hours in the regular work period for excluded employees.

60K-5.032(3) While administrative leave is provided for full-time employees, part-time employees shall be granted a prorated number of hours for each type of administrative leave based on the number of hours regularly worked during the workweek or pay period.

60K-5.032(3)(f)2 In accordance with the Florida Disaster Volunteer Leave Act, Section 110.120 Florida Statutes, an employee of a state agency who is a certified Disaster Services Volunteer of the American Red Cross may be granted a leave of absence with pay for not more than 15 working days in any 12 month period to participate in specialized disaster relief services for the American Red Cross. Such leave of absence may be granted only upon the request of the American Red Cross and with the approval of the employee's employing agency. Leave under this act shall be granted only for services related to a disaster occurring within the boundaries of the State of Florida.
Section 110.120 (Administrative Leave for Disaster Services Volunteers) Florida Statutes
- SHORT TITLE. – This section shall be known and may be cited as the "Florida Disaster Volunteer Leave Act."
- DEFINITION. – As used in this section, the following terms shall apply:
- "State agency" means any official, officer, commission, board, authority, council, committee or department of the executive branch of state government.
- "Disaster" includes disasters designated at level II and above in the American National Red Cross regulations and procedures.
- LEAVE OF ABSENCE. – An employee of a state agency who is certified Disaster Services Volunteer of the American Red Cross may be granted a leave of absence with pay for not more that 15 working days in any 12 month period to participate in specialized disaster relief services for the American Red Cross. Such leave of absence may be granted upon the request of the American Red Cross and upon the approval of the employee's employing agency. An employee granted leave under this section shall not be deemed to be an employee of the state for purposes of workers' compensation. Leave under this act shall be granted only for services related to disaster occurring within the boundaries of the State of Florida.

A regular employee of the City who is a certified disaster service volunteer of the American Red Cross may be granted administrative leave with pay for participation in specialized disaster relief services for the American Red Cross as follows:
- The employee must provide documentation of certification as a disaster service volunteer from the American Red Cross.
- For the purposes of this leave benefit, disaster includes disasters designated at level II and above in the American National Red Cross regulations and procedures.
- Upon a call to service from the American Red Cross, the employee must request authorization for Florida Disaster Volunteer (FDV) Leave in accordance with the department's leave request procedures.
- The employee must receive approval for an absence associated with a disaster and to use the leave provided herein. Consideration will be given to the City's work demands, including the City's emergency management work activities.
- Upon completion of service, the employee will be required to produce written documentation via American Red Cross form #5383 (Disaster Relief Operation Work Performance Evaluation) of the period of covered service for the emergency. Failure to produce appropriate documentation will result in denial of paid administrative leave and possible disciplinary action.

A covered employee may be granted up to 15 working days administrative leave with pay during a calendar year. For the purposes of FDV leave a working day shall not exceed 12 hours. If the employee's work shift exceeds 12 hours, the number of days leave with pay will be adjusted to equate to no more than the equivalent of 15 working days.

An employee granted FDV leave shall not be deemed an employee of the City for purposes of workers compensation for services provided and work performed under the auspices of the American Red Cross.
